PRIVACY POLICY

Please review the following terms concerning the privacy policy of the CENSUS S.A. (hereinafter “CENSUS”) Website. Hereby, you (hereinafter the “user”) agree to comply with these terms (hereinafter the “Privacy Policy Terms”):

DATA PROTECTION

The user agrees that CENSUS may collect, retain and use certain personal data (hereinafter the “data”) in connection with the services provided. The user shall be responsible for ensuring the truthfulness and accuracy of any data granted to CENSUS.

The user consents to the maintenance of the below mentioned data by CENSUS, for a period of three months, namely:

  1. the IP address making the request to the server hosting the website of CENSUS,
  2. the time that the user’s request was made as recorded by the server,
  3. the type of request made (e.g. HTTP "GET" or "POST"),
  4. the requested resource,
  5. whether the request made was successful or not (HTTP response code),
  6. the HTTP response length,
  7. the referrer page, which is the prior, clicked, page from the one the user viewed and
  8. the “user agent” string that describes the user’s browser.

The said data shall be used for technical, statistical and website security reasons and may be processed only for the aforementioned reasons, at the sole discretion of CENSUS. CENSUS does not share this data with third parties, except when this is requested by legal authorities.

If a user wishes to retrieve a copy of the data held by CENSUS related to a particular IP address, this can be provided subject to proving that the user was the holder of that IP address for the related period of time. Such requests should be made via e-mail to support [AT] census-labs.com

If a user would like to have the data held by CENSUS for a particular IP address be removed, this can be expedited subject to proving that the user was the holder of that IP address for the related period of time. Such requests should be made via e-mail to support [AT] census-labs.com

The website makes use of four types of cookies which are saved on the user's browser storage

  • A cookie related to the security of the website platform (CSRF cookie)
  • Cookies maintaining session data for users of the authenticated services of the website (content management functionality)
  • Cookie(s) maintaining a user's Website preferences regarding cookie consent
  • Cookies related to the third party Google Analytics service, which allows CENSUS to track website activity

Users may for privacy reasons opt-out of third party cookies at any time through the cookie consent dialog. Users may also remove all CENSUS related cookies, at any time, through the "clear cookies" browser functionality. CENSUS will not be liable for any claim brought by a user, subject to the extent that such action or omission resulted directly from the user’s instructions. The user undertakes to comply in all respects with any applicable laws, regulations, standards and guidelines applicable to personal data.

CENSUS shall take all commercially reasonable measures to protect the security and confidentiality of the user’s personal data against any accidental or illicit destruction, alteration or unauthorized access or disclosure to third parties.

CONFIDENTIALITY

The term “confidential information” means any information disclosed by one party (“disclosing party”) to the other party (“receiving party”) in any form (written, oral, etc.) that is marked as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of the disclosure, including, without limitation, among others, information relating to the services, trade secrets, business, financial and customer information technology and technical information (intellectual property, inventions, know-how ideas and methods), strategies and product development plans and/or the present Privacy Policy Terms. Each party understands that the disclosing party has or may disclose confidential information in connection with these Terms, but that receiving party shall receive no rights in, or licenses to, such confidential information.

The receiving party agrees:

  1. not to disclose confidential information to any third person other than those of its employees, contractors, advisors, investors and potential acquirers with a need to have access thereto and who have entered into non-disclosure and non-use agreements applicable to the disclosing party’s confidential information, and
  2. to use such confidential information solely as reasonably required in connection with the services and/or these Terms.

The user agrees to be responsible for any breach of these Privacy Policy Terms caused by him or any of its representatives. The receiving party further agrees to take the same security precautions to protect against unauthorised disclosure or unauthorised use of such confidential information of the disclosing party that the party takes with its own confidential or proprietary information, but in no event will a party apply less than reasonable precautions to protect such confidential information. Each party acknowledges that the use of such precautions is not a guarantee against unauthorised disclosure or use.

The disclosing party agrees that the foregoing will not apply with respect to any information that the receiving party can document:

  1. is or becomes generally available to the public without any action by, or involvement of, the receiving party or
  2. was in its possession or known by it, prior to receipt from the disclosing party or
  3. was rightfully disclosed to it without restriction by a third party or
  4. was independently developed without use of any confidential information of the disclosing party.

Nothing in these Terms will prevent the receiving party from disclosing confidential information as required in response to a request under applicable laws or pursuant to any judicial or governmental order or authority, provided that, to the extent permitted by law, the receiving party gives the disclosing party reasonable prior notice to contest such disclosure. Each party agrees that, upon the written request of the disclosing party, the receiving party will promptly return to the disclosing party, or provide written certification of the destruction of, all confidential information of the disclosing party, including all confidential information contained in internal documents, without retaining any copy, extract or summary of any part thereof. Notwithstanding the foregoing, a receiving party may retain copies of confidential information solely to the extent necessary for purposes of such party’s ordinary course internal document retention and backup requirements and procedures, provided that such confidential information shall remain subject to the terms and conditions of the Privacy Policy Terms for so long as it is retained.

Τhe user acknowledges that CENSUS does not wish to receive any confidential information from the user that is not necessary for CENSUS to perform its obligations under these Terms. Unless otherwise specifically agreed, CENSUS may reasonably presume that any unrelated information received from the user is not confidential, unless such information is marked as “confidential.”

For clarification purposes, “party”, under this clause is considered to be CENSUS, any user accessing the Website of CENSUS as well as any associate of CENSUS, regardless of the inter-parties relation with CENSUS.

THIRD PARTY CONTENT

Except where expressly provided otherwise by CENSUS, all comments, papers, information or materials submitted to CENSUS by third parties through or in association with the Website shall be treated as non-confidential. CENSUS shall be free to use and/or disseminate such content on an unrestricted basis for any purpose. CENSUS makes no representations, warranties, guaranties, or conditions as to the quality, suitability, truth, accuracy, or completeness of any of the contents provided by third parties and contained on the Website.

UPDATES

Updates to the Website Privacy Policy will be communicated to users through an explicit consent dialog.
